General Site Use Terms of Use
Your access to, and use of, the DancingForDessert website (the "Site") is subject to various terms and conditions described in these terms of use ("Terms of Use"). The Terms of Use are very short, and they constitute a set of legal obligations and limitations that affect you. You should therefore read through them and understand them. However, if you do not, they will still be effective.
1. General Laws are Applicable
1.1. As a condition of your access to and use of the Site, you agree to abide by all applicable local, state, provincial, national, international and other laws and regulations. This includes in particular laws relating to the protection of intellectual property. Without limiting the breadth of the preceding sentence, you agree not to:
a) attempt to gain unauthorized access to the Site, other accounts, computer systems or networks connected to the Site, through password mining or any other means;
b) interfere with or disrupt networks connected to the Site or violate the regulations, policies or procedures of such networks; or
c) interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site.
1.2. The Site is provided to individuals only and for personal use only. Any unauthorized commercial use of the Site, or the resale of its services, is expressly prohibited.
2. Ownership of Material on Site
2.1. You acknowledge that the Site contains information, photographs, graphics, video clips and other material (collectively, "Content") that are protected by or as copyrights, trademarks, service marks, trade secrets or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or subsequently developed. The Site and its Content are the property of Webdancer Studios Inc. ("Webdancer") or other persons who have contributed Content to the Site and are protected by U.S., Canadian and international copyright laws. While we at Webdancer make the Content available to Site users, we (or the people who provided the Content to us) retain all copyright and related proprietary rights in the Content. Accordingly, without our express written permission, you agree not to copy or distribute the Content or any portion of it; mirror or include the Content or any portion of it on your own server, internet web site or documents; or modify or re-use any portion of the Content.
2.2. In particular, "Webdancer Studio Inc.", "Webdancer", "www.dancingfordessert.com", and all Webdancer logo(s) are all trade marks or service marks of Webdancer. Other product and company names and logos mentioned or appearing on the Site might be the trademarks or service marks of their respective owners.
3. Modifications to Service or Terms of Use
3.1. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of the Site without notice. We will not be liable to you or to any third party for any modification, suspension or discontinuance of the Site. Further, we reserve the right to change these Terms of Use or other policies regarding the use of the Site at any time, and you are responsible for regularly reviewing the Terms of Use.
4. Advertisements, Third Party Sites and "hotlinks"
4.1. Clicking on certain links within the Site will let you leave Webdancer's Site. Any sites to which such links direct you are not under our control, and we are not responsible for the content of such linked third-party sites.
5. Indemnity
5.1. You will be legally responsible for any action you take in contravention of these Terms of Use, including for any damage caused. You therefore agree to indemnify and hold harmless Webdancer, its members, officers, employees, agents, and licensors from and against all losses, expenses, damages, claims, fines, penalties and costs, including reasonable legal and accounting fees, resulting from any alleged violation of these Terms of Use or the Site's Privacy Policy.
6. Choice of Law and Forum
6.1. This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada without giving effect to any principles of conflicts of law, and that the courts located in Vancouver, British Columbia (and courts of appeal from those courts) will have exclusive jurisdiction to hear any dispute arising under these Terms of Use or from use of the Site. You irrevocably consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
